Subject: – SOP/ Check list for issuance of completion certificate to the colonies before they are finally taken over by ULBS
It has been observed that the ULBS while proceeding with issuing completion certificate or taking over of colonies developed by private developers need to adopt a uniform and appropriate modality. In order to streamline the process, a template checklist has been drafted as a guiding document in order to proceed with such matters, as under:
1. Sanctioned layout plan:- It should be verified that the whole project has been developed as per the sanctioned layout plan.
2. Copy of licence issued by the competent authority:- To ensure the compliance of all the conditions as mentioned in the license for development of colony.
3. Copy of final notification in case of TP Scheme along with relevant schedule of clauses as applicable.
4. Field visit by Technical staff of ULB to verify that all the services and facilities such as road, water supply and sewerage, STP, tube-wells, park and open spaces, rain water harvesting systems, street lights etc. are as per Service Plans/Layout Plan. Any deficiency should be got rectified at developer’s cost with due intimation to it. The detailed report in this regard by the Technical staff should be obtained.
5. Affidavit by the developer regarding no pending litigation/complaint with any department/authority or the residents In case of any pending litigation, detail to be furnished for its assessment on its impact.
6. Affidavit by the developer to ensure that the compliances of all the Statutory Authorities such as PPCB, Environment Clearance, CGWB (PWRDA), SWM, PEDA, licensing authority itself etc., all authorities as mentioned in licence/approval, with regard to satisfactory completion/compliance of their scope of services has been done. It is mandatory for the ULB to obtain NOC from the concerned department/authority before issuance of completion certificate
7. Affidavit by the developer to ensure that the entire internal electrical distribution network including the required capacity of transformers and transmission lines has been laid as per the drawings approved by PSPCL and to the entire satisfaction of PSPCL. It is mandatory for the ULB to obtain NOC from the concerned department/authority before issuance of completion certificate
8. Affidavit by the developer to ensure that fire system has been laid as per the norms of the Fire Department. It is mandatory for the ULB to obtain NOC from the concerned department/authority before issuance of completion certificate.
9. To ensure and verify that the project has been duly registered under RERA regulations and certificate in this regard should be obtained from the developer.
10. To ensure that the Bank Guarantees submitted by the developers are still alive and operational.
11. Title transfer document from promoter regarding transfer of ownership of public buildings, parks, roads, STPs and other public utility places before the completion and the ownership of the same should be actually transferred to the name of ULB as per provisions of the Act before the colony is taken over by the ULB.
12. After the colony is developed in all aspects, the colonizer will get the completion Certificate from the Competent Authority. Thereafter, as per chapter 2 of PAPRA under section 5 (13), colonizer/promoter shall be responsible for the maintenance and keep up of all roads/open spaces, public parks, public health services for a period of 5 years from the date the issue of completion certificate or till the date of transfer the same free of cost to the State Government or Local authority and in case of TP schemes colonizer has to maintain the colony (services and amenities etc) for 5 years before handing it over to the concerned ULB, as per Government orders dated 27.04.2021. To ensure that all the services are in good and operational condition before the colony is taken over by the ULB.
13. Compliance of EWS will be as per the policy dated 24.10.2016.
14 Promoter/colonizer/ builder shall be solely responsible for any type of litigation pending if any, with the land owners, allottees etc. and he shall indemnify the Govt./ ULB for the
same.

Certificates in respect of above be placed in record. ULBS shall be at liberty to include any additional check in general or specific to their matter in hand in order to safeguard public interest. Henceforth, these instructions are to be complied with in letter and spirit.
